P&P Car Rentals LLC Car Rental Terms & Conditions Effective Date: [INSERT EFFECTIVE DATE] These Terms and Conditions (“Terms”) govern the rental and use of vehicles from P& Car Rentals LLC (“P& Car Rentals,” “Company,” “we,” “us,” or “our”) by any person who rents, drives, or is otherwise authorized to use a vehicle rented from the Company (“Renter,” “you,” or “your”). By signing a Rental Agreement, making a reservation, taking possession of a vehicle, or operating a vehicle rented from P& Car Rentals, you acknowledge that you have read, understood, and agreed to these Terms and the applicable Rental Agreement. Important: Your individual Rental Agreement may contain additional rates, fees, restrictions, vehicle-specific requirements, and other terms. If a provision of the signed Rental Agreement conflicts with these Terms, the signed Rental Agreement will control to the extent permitted by applicable law. 1. Rental Agreement Each rental is subject to: These Terms and Conditions; The individual Rental Agreement provided at the time of rental; The vehicle inspection or condition report; Applicable fees, taxes, surcharges, and optional products selected by the Renter; and Applicable federal, state, and local laws and regulations. The Renter will receive or have access to a copy of the completed Rental Agreement. 2. Eligibility to Rent To rent a vehicle from P& Car Rentals, the Renter must: Meet the Company's minimum age requirement for the selected vehicle; Present a valid driver's license acceptable to the Company; Present valid government-issued identification when requested; Provide a valid payment method accepted by the Company; Satisfy applicable insurance, credit, verification, and rental requirements; Provide accurate and complete information; and Be legally permitted to operate the rented vehicle. Additional age requirements, young-driver fees, vehicle restrictions, documentation requirements, or insurance requirements may apply. P& Car Rentals reserves the right to refuse a rental when legally permitted if the Renter does not satisfy the Company's rental requirements. 3. Authorized Drivers Only the following persons may operate a rented vehicle: The primary Renter named in the Rental Agreement; and Additional drivers properly authorized and recorded by P& Car Rentals. An additional-driver fee may apply. The Renter is responsible for ensuring every authorized driver complies with these Terms and the Rental Agreement. Allowing an unauthorized person to operate the vehicle may constitute a breach of the Rental Agreement and may result in additional charges, loss of optional protections, and liability for damage, loss, or other expenses to the extent permitted by law. 4. Identification & Verification P& Car Rentals may verify the Renter's identity, driver's license, payment information, insurance information, and other information reasonably necessary to complete a rental transaction. Additional documentation may be required when reasonably necessary to verify eligibility or comply with applicable law. 5. Payment & Charges The Renter agrees to pay all amounts properly due under the Rental Agreement, including applicable: Base rental charges; Mileage and excess-mileage charges; Taxes and government-imposed fees; Optional products and services; Additional-driver or young-driver fees; Fuel or refueling charges; Late-return charges; Cleaning, smoking, vaping, or odor-removal charges; Tolls and toll-administration charges; Parking and traffic-related charges; Damage or loss charges; Recovery or towing expenses; and Other charges disclosed in the Rental Agreement. The Renter authorizes P& Car Rentals to charge the payment method provided for amounts properly due under the Rental Agreement, subject to applicable law. 6. Security Deposit / Authorization Hold P& Car Rentals may require a security deposit or temporary authorization hold on the Renter's payment method. The amount may vary depending on the vehicle, rental period, payment method, renter eligibility, and other applicable requirements. A security deposit or authorization hold is not necessarily the final amount owed. After the vehicle is returned and the rental account is reviewed, properly owed amounts may be applied to the Renter's account. Release times for authorization holds are controlled by the applicable bank, financial institution, or card issuer. 7. Rental Period & Extensions The rental period begins at the time stated in the Rental Agreement or when the Renter takes possession of the vehicle, as applicable. The vehicle must be returned on or before the date and time specified in the Rental Agreement unless P& Car Rentals approves an extension. Extensions must be approved before the original return time. Continuing to possess the vehicle does not automatically extend the rental. 8. Late Returns Vehicles returned after the agreed return time may be subject to additional rental charges, late fees, or other charges disclosed in the Rental Agreement. If a vehicle is not returned when required, P& Car Rentals may take lawful steps to recover possession of the vehicle and may charge reasonable recovery costs permitted by law. 9. Early Returns Returning a vehicle before the scheduled return date does not automatically entitle the Renter to a refund. Refunds or adjustments will be handled according to the reservation terms and applicable Rental Agreement. 10. Cancellations & No-Shows Cancellation and no-show policies may vary depending on the reservation, vehicle, promotional rate, payment method, and rental location. Applicable cancellation fees, deposit forfeitures, or other charges will be disclosed during the reservation process or in the Rental Agreement. 11. Vehicle Inspection & Condition The Renter agrees to inspect the vehicle before leaving the rental location and promptly report any existing damage, mechanical issue, warning light, or other condition that has not already been documented. Renters are encouraged to photograph the vehicle at pickup. The vehicle is provided in the condition documented in the Rental Agreement or inspection report. 12. Vehicle Return Condition The vehicle must be returned: On time; To the agreed return location; With all keys, accessories, equipment, and documents; In substantially the same condition as received, except for ordinary wear and tear; and With the required fuel level. The Renter may be responsible for reasonable costs resulting from damage beyond ordinary wear and tear, subject to applicable law and any applicable damage waiver or protection purchased. 13. Damage, Loss & Theft The Renter may be responsible, to the extent permitted by law and subject to the Rental Agreement and any applicable protection purchased, for loss of or damage to the vehicle occurring during the rental period. This may include damage or loss resulting from: Collision or vandalism; Theft; Negligent or prohibited use; Unauthorized drivers; Misuse of the vehicle; Flood or water damage; Tire or wheel damage; Interior damage; Missing equipment; Lost keys or key fobs; Improper fueling; and Towing or recovery. 14. Collision / Loss Damage Waiver If P& Car Rentals offers a Collision Damage Waiver (CDW), Loss Damage Waiver (LDW), or similar optional protection, applicable fees, limitations, exclusions, and conditions will be separately disclosed. A damage waiver is a contractual product and is not necessarily insurance. Unless specifically stated in writing, purchasing a waiver does not eliminate responsibility for excluded events, prohibited use, unauthorized drivers, negligence, intentional conduct, or other excluded circumstances. 15. Insurance The Renter is responsible for complying with all applicable insurance requirements. P& Car Rentals may require acceptable proof of insurance before providing a vehicle. Any optional insurance-related products will be subject to separately disclosed terms, limits, exclusions, and charges. 16. Prohibited Uses Unless expressly authorized in writing, a rented vehicle may not be: Used for racing, speed testing, track events, or competition; Driven off-road; Used to tow or push another vehicle or trailer; Used to transport hazardous materials; Used for unlawful purposes; Operated while the driver is impaired by alcohol, drugs, or another substance; Operated by an unauthorized driver; Used to carry more passengers than legally permitted; Used in violation of traffic or motor-vehicle laws; Used to transport illegal substances or contraband; Used for commercial transportation unless specifically authorized; Used for rideshare, delivery, or courier activities unless specifically authorized in writing; Deliberately damaged, disabled, or misused; or Operated outside an authorized geographic area. 17. Geographic Restrictions Vehicles may be driven only within areas permitted by the Rental Agreement. Interstate travel may be permitted unless specifically restricted. International travel, including travel into Canada or Mexico, is prohibited unless P& Car Rentals provides prior written authorization and all applicable requirements are satisfied. 18. Tolls, Parking & Traffic Violations The Renter is responsible for tolls, parking charges, traffic violations, camera violations, congestion charges, and similar governmental or third-party charges incurred during the rental period. Reasonable administrative charges may also apply when permitted and properly disclosed under applicable law and the Rental Agreement. 19. Fuel Unless otherwise stated in the Rental Agreement, the vehicle must be returned with approximately the same fuel level as at pickup. Refueling charges may apply if the vehicle is returned below the required level. The Renter is responsible for damage caused by using the wrong fuel or improper fluids. 20. Mileage A rental may include unlimited mileage or a specified mileage allowance, depending on the vehicle and Rental Agreement. Any excess-mileage charges will be disclosed in the applicable Rental Agreement. 21. Smoking, Vaping & Odors Smoking and vaping are prohibited in P& Car Rentals vehicles unless expressly authorized in writing. Reasonable cleaning or remediation fees may apply when specialized treatment is necessary, subject to applicable law. 22. Pets & Animals Pets may be transported only in accordance with applicable Company policy. Service animals will be accommodated as required by law. Cleaning or damage costs resulting from animals may be charged where permitted by law. 23. Child Safety The Renter is responsible for complying with applicable child passenger safety and restraint laws and for properly selecting and installing any child safety seat used in the vehicle. 24. Breakdowns & Mechanical Problems If a vehicle experiences a mechanical problem or becomes unsafe to operate, contact P& Car Rentals promptly using the emergency or roadside-assistance contact information provided with the rental. Do not authorize major repairs without prior approval except where immediate action is reasonably necessary to protect people or prevent additional damage. 25. Accidents In the event of an accident, the Renter must: Stop safely and comply with applicable law; Contact emergency services when necessary; Obtain medical assistance for injured persons; Notify law enforcement when required; Obtain information from involved parties and witnesses when reasonably possible; Take photographs when safe to do so; Notify P& Car Rentals as soon as reasonably possible; and Cooperate with applicable insurance and claims procedures. The Renter must not admit liability or settle a claim on behalf of P& Car Rentals without authorization. 26. Vehicle Theft If a rented vehicle is stolen, the Renter must immediately notify law enforcement and P& Car Rentals and provide requested information, including the police report number and circumstances of the theft. 27. Keys & Access Devices The Renter is responsible for keys, key fobs, remote devices, transponders, and other equipment supplied with the vehicle. Lost or damaged devices may result in reasonable replacement and programming charges as permitted by law. 28. Personal Property P& Car Rentals is not responsible for personal property left in a vehicle after the rental period except to the extent required by applicable law. Please remove all personal belongings before returning the vehicle. 29. Vehicle Technology & Telematics Rental vehicles may contain technology used for vehicle operation, safety, maintenance, security, navigation, mileage, diagnostics, or fleet management. Renters must not disable or tamper with manufacturer-installed safety, security, tracking, telematics, or diagnostic systems. 30. Personal Devices & Vehicle Systems Before returning a vehicle, the Renter should: Unpair personal phones and Bluetooth devices; Remove personal contacts and navigation information; Sign out of personal accounts; Delete saved addresses and destinations where possible; and Remove personal information from the infotainment system. 31. Cleaning & Excessive Dirt Vehicles must be returned in reasonably clean condition. Reasonable cleaning or remediation charges may apply for conditions beyond normal use, including excessive dirt, stains, spills, pet-related cleaning, smoke or vaping odors, bodily fluids, or unusual contamination. 32. Abandoned Vehicles A rented vehicle may not be abandoned. Unauthorized abandonment may result in towing, storage, recovery, transportation, and related charges permitted by law. 33. Reservations & Vehicle Substitution Reservations may apply to a vehicle category rather than a specific vehicle. When a reserved vehicle becomes unavailable, P& Car Rentals may provide a comparable vehicle, subject to applicable law and reservation terms. 34. Right to Refuse or Terminate Rental P& Car Rentals may refuse or terminate a rental when legally permitted if: The Renter does not satisfy rental requirements; Materially false or misleading information is provided; The Rental Agreement is violated; The vehicle is used for a prohibited purpose; The vehicle is at risk of damage or unlawful use; or Other circumstances legally permit termination or refusal. P& Car Rentals will comply with applicable anti-discrimination and consumer-protection laws. 35. Fraudulent or Unauthorized Payments P& Car Rentals may take lawful action when a payment is reversed, disputed, fraudulent, unauthorized, or otherwise invalid. The Renter remains responsible for legitimate amounts properly due under the Rental Agreement, subject to applicable law. 36. Electronic Communications By providing electronic contact information, the Renter agrees that P& Car Rentals may use it for communications concerning reservations, rental transactions, payments, vehicle returns, customer service, safety notices, and other rental-related matters. Marketing communications will be handled according to applicable consent and opt-out requirements. 37. Privacy P& Car Rentals may collect and use personal information reasonably necessary to provide rental services, process payments, verify identity and eligibility, administer reservations, maintain vehicles, manage claims, comply with legal obligations, and protect Company property. Information may be shared with service providers, payment processors, insurers, governmental authorities, law enforcement, or other parties when reasonably necessary and permitted or required by law. Any separate P& Car Rentals Privacy Policy is incorporated into these Terms where applicable. 38. Additional Rental Charges Applicable rental prices and mandatory charges will be disclosed as required by law. Additional charges may arise from circumstances occurring during or after a rental, including damage, tolls, violations, fuel shortages, late returns, excessive cleaning, or other authorized charges. 39. Disputes & Claims Renters should first contact P& Car Rentals to attempt to resolve billing, damage, reservation, or service disputes. Nothing in these Terms is intended to waive any right or remedy that cannot legally be waived. 40. Governing Law The Rental Agreement will be governed by the laws applicable to the rental transaction and rental location, except where federal or other mandatory law provides otherwise. Rentals originating in New Jersey will generally be governed by New Jersey law to the extent permitted by law. Rentals originating in Massachusetts will generally be governed by Massachusetts law to the extent permitted by law. 41. Compliance With Applicable Laws P& Car Rentals and the Renter agree to comply with applicable federal, state, and local laws concerning motor-vehicle rentals, consumer protection, insurance, taxes, licensing, vehicle safety, privacy, and related matters. 42. Severability If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, it will be modified or removed only to the minimum extent necessary, and the remaining provisions will continue in effect. 43. No Waiver Failure by P& Car Rentals to enforce a provision on one occasion does not waive the Company's right to enforce that provision in the future. 44. Entire Agreement The signed Rental Agreement, these Terms, applicable fee schedules, inspection documentation, and supplemental terms constitute the agreement concerning the rental except as otherwise required by law. 45. Renter Acknowledgment By making a reservation, signing a Rental Agreement, or taking possession of a vehicle, the Renter acknowledges that: The Renter has had an opportunity to review the rental terms; The Renter understands the rental period and applicable charges; The Renter understands the authorized-driver requirements; The Renter understands vehicle-use restrictions; Additional charges may apply under the circumstances described in the Rental Agreement; The vehicle must be returned as required; and The Renter agrees to comply with these Terms and the applicable Rental Agreement.
